Question: When is it proper to use the federal registration symbol?

Answer:
The federal registration symbol may be used once the mark is actually registered in the U.S. Patent and Trademark Office. Even though an application is pending.


Question: Are there any restrictions from trademarking a product name that contains Spanish words?

Answer:
The same laws and rules apply to marks in languages other than English. Other than those requirements, a non-English mark would have to be translated for the record.

Question: Must my business name be registered as a corporation or a fictitious name before I can register a trademark?

Answer:
No. Registration as a corporation or of a fictitious name is not required before registering a trademark.
